cancel any order (even if it has already been accepted) by notice in writing and without penalty. In the event that this occurs the Hirer’s security deposit will be refunded, less a $30 administration charge for reasonable expenses incurred in placing and securitising your booking.
The Hirer may cancel an order but will forfeit all booking deposits and in addition is subject to and agrees to the below specified contractual cancellation conditions, estimating the reasonable loss incurred by Perth Bouncy Castle Hire in booking amendments or cancellations.
By reserving and booking an item for hire, the Hirer is removing the ability of this item to be hired to another individual. Accordingly, Perth Bouncy Castle Hire forfeit all potential income derived from the hire of that item to another individual. This similarly applies where you book equipment for use in an outdoor venue, where weather conditions may impact the ability of this item to perform, where another more suitable indoor venue may have resulted in a successful hire.
For these reasons, please carefully read and understand the below cancellation terms, as by agreeing to these terms and conditions you are agreeing to these terms;
The hirer may cancel by delivery of a written notice to Perth Bouncy Castle Hire not later than twenty-eight (28) days before the date of the event to be eligible for a full refund. Full refunds will only be made if you cancel or make any changes to the date of the event due to bad weather conditions only.
WITHIN 28 DAYS: Bookings cancelled within twenty-eight (28 days) are not eligible for a full refund. However, the 50% deposit will be kept as credit and can be used for future bookings within 12 months of the cancellation date.
WITHIN 14 DAYS: Bookings cancelled within fourteen (14) days of the event date are not eligible for a full refund. The entire invoiced amount is payable to Perth Bouncy Castle Hire. However, the full amount will be kept as credit and can be used for future bookings within 12 months of the cancellation date.
WITHIN 7 DAYS: Bookings cancelled within seven (7) days of the event date are not eligible for a full refund or credit. The entire invoiced amount is payable to Perth Bouncy Castle Hire.
Delivery and Collection
Goods will be delivered in a clean, but not necessarily sterile, state. The Hirer is responsible to ensure any Goods from which food or drinks are to be served are fit for use and or that any relevant permits applicable if operating in a public place, are obtained.
The Hirer must allow Perth Bouncy Castle Hire’s employees, servants, agents and insurers access to the Goods at all reasonable times to deliver, install, remove, inspect, test, adjust, maintain, repair or replace them. The Hirer is responsible for providing safe and proper access to and at the Site. The Hirer is liable for all injury, loss or damage suffered by Perth Bouncy Castle Hire, its employees or agents while at the Site.
The Hirer must make the Goods available for collection by Perth Bouncy Castle Hire at the end of the Hire Period. For inflatables, do not dismantle or in any way attempt to move an inflatable as our trained installers will dismantle these. The Hirer must ensure however, that they wipe over the inflatable carefully with a towel to ensure it is clean and dry. For all other hire items, the Hirer will ensure they are empty, clean, dry and packed into their respective containers and crates in a complete state. Additional charges will apply where the Goods are not returned in this condition.
Responsibility of Hirer
The Hirer bears all risk in the Goods for the Hire Period, including the Hirer’s ability or competence to use the equipment hired.
During the Hire Period, the Hirer is responsible for:
safekeeping of the Goods during the Hire Period;
using of the Goods in strict conformity with the Goods’ instructions or specifications;
not using pigmented streamers or decorations within or near any marquee hired;
ensuring that the Goods are not moved from the Site, unless in an emergency and Perth Bouncy Castle Hire is advised immediately afterwards;
complying with all relevant laws, by-laws and regulations applicable to the installation, use and operation of the Goods;
protecting the Goods against soilage, damage, fire, tempest, flood, theft, distress or seizure;
using only fuel, power and consumables specified by Perth Bouncy Castle Hire;
ensuring that the Goods are not operated for any purpose beyond their rated capacity or in a manner likely to result in undue wear;
in the event any Goods break down or become unsafe, ensuring appropriate steps are taken to prevent injuries to persons and to prevent the Goods sustaining further damage; and
for safe operation of the Goods and supervision of all users of the Goods.
Safe Operation Rules and Safety Compliance
The Hirer is electing to self-supervise the operation and use of the Goods, and warrants that they will strictly adhere to the Safe Operation Rules contained in Annexure B and all other safety training, information sheets and instructions provided to them by Perth Bouncy Castle Hire in relation to the hire Goods.
The Hirer understands and agrees that Perth Bouncy Castle Hire will deliver and install the Goods and provide the Hirer with instructions for safe operation and supervision of the Goods, but safe operation and supervision of the Goods during the Hire Period is the sole responsibility of the Hirer and not Perth Bouncy Castle Hire.
The Hirer warrants that they have read, understood and agrees to be bound by the Risk Warning contained in Annexure A. The Hirer further acknowledges that this Risk Warning is a part of their contract with Perth Bouncy Castle Hire for the supply of recreational services.
The Hirer must comply with all instructions and directions of Perth Bouncy Castle Hire or its installer regarding safety and supervision in respect of the use of the Goods, and in respect of the provision or display of the Risk Warning to all participants or patrons who will be using the Goods and the parents or guardians of participants who are under 18 years old.
Any failure to comply with clause 3 will result in the booking being unable to proceed and the full hire fee being charged.
The Hirer understands that there are a number of risks, including but not limited to the risk of injury and death, from the use and operation of the Goods and understands that they, and other people they allow to use the Goods, use the Goods wholly at their own risk. The Hirer further understands that Perth Bouncy Castle Hire has no liability for any act, default or negligence of the Hirer in allowing other people to use the Goods or in the supervision of others in relation to the use of the Goods.
Insurance and Indemnity
The Hirer releases and indemnifies Perth Bouncy Castle Hire and its officers, employees and agents (those indemnified) from and against any:
liability, loss, damage or expense incurred by those indemnified arising from any breach of these Terms, negligent or wilful acts or omissions (Wrongful Conduct) by the Hirer; and
loss or damage caused to the Goods during the Hire Period, subject only to the exclusion of defects arising out of the proper and ordinary use as specified in clause 10 of these terms,
except to the extent that any Wrongful Conduct of those indemnified caused or contributed to the relevant liability, loss, damage, or expense.
The Hirer releases and indemnifies Perth Bouncy Castle Hire and its officers, employees and agents (those indemnified) from and against any loss, damage or liability arising from any claims made against Perth Bouncy Castle Hire by third parties arising out of or in connection with the supply of the Goods to the Hirer, and the use of the Goods during the Hire Period.
The Hirer agrees that Perth Bouncy Castle Hire will be taken to be acting as agent or trustee for and on behalf of those indemnified.
Each indemnity in these Terms is a continuing obligation separate and independent from the other obligations and survives the completion of the Hire Period or termination of these Terms.
The Hirer will maintain at its own expense the following policies of insurance:
for loss of or theft of the equipment hired in an amount not less than the replacement cost;
for loss of business or perishable Goods as a result of damage to or breakdown of equipment hired; and
public liability insurance coverage in an amount not less than $10 million per occurrence,
and understands that failure to do so may personally expose them to un-insured liability to Perth Bouncy Castle Hire for any loss or damage to the Goods.
The Hirer must provide current certificates of currency for the insurances maintained under clause 5 within three business days of a request by Perth Bouncy Castle Hire.
Breakdown or Defect
The Hirer must inspect all Goods on receipt and notify Perth Bouncy Castle Hire of any loss of or damage to the Goods immediately should the same occur.
Breakdowns or defects in the Goods resulting from:
proper and ordinary use; or
the development of an inherent fault or a fault not ascertainable prior to start of the Hire Period;
may, at Perth Bouncy Castle Hire option, either be repaired or the Goods replaced at Perth Bouncy Castle Hire’s expense.
If repair is impracticable and if replacement Goods are not available, the proportional charge for broken or defective Goods will be credited to the Hirer and Perth Bouncy Castle Hire will not have any other liability whatever to the Hirer.
No relief from hire charges nor any claims will be allowed by Perth Bouncy Castle Hire:
for stoppages or damages due to causes out of Perth Bouncy Castle Hire’s control including, without limitation, breakdowns, bad weather or site conditions; or
the Hirer not informing Perth Bouncy Castle Hire of the defect or breakdown immediately it occurs.
The Hirer must not try to effect any repairs on the Goods without the prior approval of Perth Bouncy Castle Hire.
Default and Termination
If the Hirer:
breaches any term of the Terms;
is an individual and becomes bankrupt or enters into any scheme of arrangement or composition for the benefit of his or her creditors; or
is a corporation and becomes insolvent or enters into any scheme of arrangement, any assignment or composition with or for the benefit of its creditors, has as a liquidator, administrator, receiver or manager appointed, or any action is taken for winding up or dissolution,
then Perth Bouncy Castle Hire may, without prejudice to any other remedy available to it:
require immediate payment of all money which would become payable by the Hirer to Perth Bouncy Castle Hire at a later date on any account, without further notice;
charge the Customer interest on any sum at a rate of 9% per annum from the due date until the date of payment in full;
charge the Hirer for, and the Hirer must indemnify Perth Bouncy Castle Hire from, all costs and expenses (including without limitation all legal costs and expenses) incurred by it resulting from the default or in taking action to enforce compliance with the Terms or to recover the Goods;
charge the Hirer for the cost of repairing or replacing any lost, damaged or destroyed Goods;
charge the Hirer for subsequent lost hire charges as a result of the Goods being lost, damaged or destroyed until the Goods are repaired or replaced;
claim damages from Hirer for breach of the Hire Contract; and/or
cease or suspend for such period as Perth Bouncy Castle Hire thinks fit, supply of any further Goods to the Hirer.
On termination, the Hirer must immediately make the Goods available for collection. If the Hirer does not, Perth Bouncy Castle Hire is entitled to enter any land and or premises of the Hirer where the Goods are suspected to be to repossess the Goods. Perth Bouncy Castle Hire will not be liable for any damage caused and the Hirer must indemnify Perth Bouncy Castle Hire from any liability to it or any third party in respect of any damage, demands, proceedings, costs and expenses howsoever arising.
Perth Bouncy Castle Hire will not be liable for any loss or damage suffered by the Hirer where Perth Bouncy Castle Hire has failed to meet any delivery date or varies, cancels or suspends the supply of the Goods, subject to refund of the Hirer’s 50% booking deposit minus a reasonable administration charge of $30 in accordance with clause 5 of these Terms.
Perth Bouncy Castle Hire shall have no liability to the Hirer for or in respect of any indirect or consequential losses (including without limitation loss of actual or anticipated profit or revenue, business interruption, delay costs, financing costs, holding costs and loss of opportunity), even if such loss or damage was reasonably forseeable, arose naturally or was in the contemplation of the parties.
Perth Bouncy Castle Hire’s total aggregate liability to the Hirer arising out of or in connection with Goods, whether under the law of contract, in tort (including negligence), in equity, under statute or otherwise, is limited to the hire charges applicable to the Goods. The limit of liability provided for in this clause does not apply to liability for wilful misconduct, or fraudulent or criminal acts or omissions.
If, and to the extent that, any of this clause 12 is void as a result of section 64 of the Australian Consumer Law (ACL) (being Schedule 2 to the Competition and Consumer Act 2010 (Cth) (CCA)), then Perth Bouncy Castle Hire’s liability under these Terms is limited to:
the supplying of the relevant Goods again; or
the payment of the cost of having the Goods supplied again.
The ACL provides certain guarantees (statutory guarantees) which generally require that services supplied to you:
are rendered with due care and skill;
are reasonably fit for any purpose which you, either expressly or by implication, make known to the supplier and might reasonably be expected to achieve any result you have made known to the supplier; and
are supplied within a reasonable time (when no time is set).
However, because the supply of the Goods by hire is a recreational service (as defined in the CCA), Perth Bouncy Castle Hire is entitled to exclude, restrict or modify its liability to you for a failure to comply with a statutory guarantee in respect of the supply of those services.
Accordingly, to the maximum extent permitted by section 139A of the CCA, you agree that Perth Bouncy Castle Hire excludes all liability to you for death or injury arising out of or in connection with a failure by Perth Bouncy Castle Hire failing to comply with any statutory guarantee.
Except as specifically set out in the Terms, any other term, condition or warranty in respect of the quality, fitness for purpose, condition, description, assembly, manufacture, design or performance of the Goods, is hereby expressly excluded.
In this clause 12, “injury” means:
physical or mental injury (including the aggravation, acceleration or recurrence of such an injury);
the contraction, aggravation or acceleration of a disease; or
the coming into existence, the aggravation, acceleration or recurrence of any condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs in relation to you that is or may be harmful or disadvantageous to you or the community, or that may result in harm or disadvantage to you or the community.
The exclusion of liability in this clause 12 does not apply if you have suffered any significant personal injury that is caused by Perth Bouncy Castle Hire’s reckless conduct (within the meaning given to those terms by the CCA).
Nothing in these Terms excludes, restricts or modifies any term, condition, warranty, guarantee, right or remedy (including under a statutory guarantee) which cannot lawfully be excluded, restricted or modified.
Otherwise, and except as expressly included in these Terms, all implied terms, conditions, warranties, rights or other additional obligations that can be lawfully excluded are excluded from these Terms. In particular, but subject to clause 11, Perth Bouncy Castle Hire is not liable for:
breach of terms implied that services will be provided with reasonable care and skill,
at common law that in either case results in your death or injury arising out of or in connection with the supply to you of the Goods.
Jurisdiction and Severability
The law of Western Australia, and where applicable, concurrent operation of Commonwealth legislation regarding Consumer contracts, govern these Terms. The parties agree to the exclusive jurisdiction of the courts of Western Australia, Federal Court of Australia, and of courts entitled to hear appeals from those courts.
Failure by Perth Bouncy Castle Hire to enforce any of these Terms shall not be construed as a waiver of any of Perth Bouncy Castle Hire rights. Wherein any term is unenforceable it shall be read down with an implied construction intending for the provision to be enforceable. If it cannot be so read down, the term shall be severable from these Terms in isolation, without affecting the enforceability of the remaining terms.

Please ensure that the following safety instructions are followed. The Hirer and any other supervisor of the Inflatable must be alert to weather conditions at all times and follow the instructions below regarding weather conditions.
How To Supervise an Inflatable
A Responsible Adult Is Required At All Times

Three minutes per session.
Ensure all patrons using the Inflatable at any one time are of similar size. eg. Do not mix 12 year olds with toddlers.
Children under 3 years old should not be allowed onto the Inflatable, unless accompanied by an adult.
Pay careful attention to patrons who are on the front step as they come out the slide or entering into the Inflatable. Shield them from falling off the step.
On Inflatables with separate exits and entrances, all patrons must exit out the slide to prevent collision with another patron.
Pay careful attention to the weather conditions. If winds exceed 35kmh, you must evacuate all patrons immediately and turn off the blower.
For events with more than 30 attendees, create 2 lines for the patrons to line up. Divide the 2 lines into similar sized groups (Do not allow teenagers on with toddlers). Each round of patrons allowed on the Inflatable will have a 3 minute play. As you get to the last minute, alert the patrons they have one more minute. Once you reach 3 minutes, all patrons must be off the Inflatable before the next round of patrons enter.
Watch the activity of patrons constantly and remove those who disobey your instructions. Use a whistle or similar warning as a way to attract attention should any misbehaviour occur.
Patrons that are unwell or with mental, physical impairment and/or pregnant should not be allowed to use this Inflatable.
The responsible adult supervising the Inflatable must be stationed in between the entrance and exit of the Inflatable. For large Inflatables, 2 adults are recommended. Make periodic checks of the Inflatable, the anchoring system, blower tubes and zips, and blower/s to ensure they remain in good operating condition and have not come loose.
No silly strings inside the Inflatable as it will be very difficult to remove (general cleaning fee of $150 applies if found).

- After the rain settles, you will need to wipe down the inflatable with towels before use to avoid the patrons slipping. It is the hirers responsibility to ensure the inflatable is dry before use.
What To Do If It’s Windy:
- If wind speeds exceed 35kmh or signs of willy winds approaching, evacuate the patrons from the inflatable immediately.
- Turn off the power and allow it to deflate. To speed up the process, most inflatables have velcro zips, where you can unzip the sides to let the air out.
What To Do If The Inflatable Deflates or Loses Power:
- Check the blower ventilation to make sure nothing is blocking the fan. Objects such as balloons, leaves, plastic bags or party strings can sometimes be the cause of this.
- Check the blower tubes to make sure it hasn’t come undone.

- Check the blower switch and power point to make sure it hasn’t been turned off.
- Check the extension cords to make sure it hasn’t come apart, tampered with or been damaged.
- Check the mains power or generator to make sure it hasn’t tripped.
- In the event that the blower overheats, switch the blower off at the mains then switch it back on again 1 or 2 minutes later and it should restart. If it does not, inform us straight away on 0406 161 959.
